Pursuant to Article 53 of the Statute of Passenger Transport “TRANSKOP” JSC Bitola, on 30 December 2024, the General Manager of the Company adopted the following:
GENERAL TERMS AND CONDITIONS OF TRAVEL
1 These Terms and Conditions of Travel define the general terms and rules for the transport of passengers in intermunicipal and international road transport using the vehicles of Passenger Transport Transkop A.D. Bitola.
1.1 The General Terms and Conditions of Travel defined in this document comply with the Law on Contracts for Carriage in Road Transport (Official Gazette of the Republic of Macedonia Nos. 23/13 and 156/15), the Law on Road Transport and all bylaws regulating this matter.
1.2 Certain terms used in these General Terms and Conditions of Travel shall have the following meanings:
– A Carrier is a domestic or foreign person or legal person that owns means of transport or uses them under a leasing agreement and, pursuant to a contract of carriage and for a specified fee, transports passengers within the territory of the Republic of Macedonia or beyond its borders;
– A Transport User is a domestic or foreign natural or legal person that owns means of transport or uses them under a leasing agreement and, pursuant to a contract of carriage and for a specified fee, transports passengers within the territory of the Republic of Macedonia or beyond its borders;
– A Passenger is a person transported by the Carrier, for a specified fare or pursuant to a contract of carriage, in a vehicle intended for passenger transport in road traffic;
– A Transport Organiser is a legal person who, in its own name and on behalf of the Transport User, concludes a contract of carriage with the Carrier;
– Baggage means items that the Passenger is entitled to carry pursuant to a contract and/or the General Terms and Conditions for Passenger Transport and which are placed in the area of the vehicle designated for that purpose;
– Hand Baggage means items that may be brought into the passenger compartment of the vehicle, placed in the area designated for that purpose or in front of or under the Passenger’s seat, and kept under the Passenger’s own supervision;
– Place of Departure means the place where the agreed passenger transport begins;
– A Travel Ticket is a document enabling the Passenger to exercise the right to transport to a specified destination. The Travel Ticket may be issued in paper form by bus stations and other points of sale, or in electronic form through online ticket sales websites with which the Company has concluded sales agreements or through the Company’s own website. The Travel Ticket constitutes proof that a contract of carriage has been concluded with the Passenger.
– An Electronic Ticket Reservation represents the Passenger’s intention to travel with the Carrier on a specified route, whereby the Passenger is required to confirm or cancel the Travel Ticket at least 3 hours before the scheduled departure time.
– A Contract of Carriage is a document concluded between the Carrier and the Transport Organiser, which regulates in greater detail the rights and obligations of the contracting parties.
2 General Obligations and Liability of the Passenger When Using the Carrier’s Services
2.1 The Passenger shall bear all costs related to the journey, including the cost of purchasing the Travel Ticket in accordance with the Carrier’s Price List, reservation fees, additional baggage charges, bus station service fees and similar costs.
2.2 At the request of the Driver or another representative of the Carrier, the Passenger shall present the Travel Ticket for inspection and shall retain it for the entire duration of the journey.
2.3 The Passenger may purchase an electronic ticket no later than 2 hours before the scheduled departure of the bus and must confirm the reservation for the return Travel Ticket at least 3 hours before the scheduled departure. Otherwise, the Carrier shall not be liable if there are insufficient seats available in the vehicle.
2.4 The Passenger shall be liable to the Carrier for any intentional or unintentional damage caused by the Passenger to the vehicle or its equipment during the journey or while boarding or leaving the vehicle.
2.5 The Passenger shall submit any complaint concerning the journey, as well as any claim for compensation arising from a delay or interruption of the journey, to the Carrier within 7 (seven) days from the date on which the journey ended or should have ended. Otherwise, the Passenger shall lose the right to any compensation and/or the exercise of any other right.
2.6 The Passenger must comply with the instructions issued by the Driver and the accompanying personnel. The bus crew is authorised to remove Passengers from the journey if they are clearly intoxicated or under the influence of drugs. The same shall apply to Passengers who endanger the safety of other Passengers for any reason or significantly disturb their comfort and well-being. In such cases, the Passenger shall not be entitled to alternative transport and/or any refund of the Travel Ticket. Smoking on the bus, including the use of electronic cigarettes, is strictly prohibited.
2.7. Passengers who intentionally or through gross negligence cause soiling inside the bus shall pay the Carrier a cleaning fee of at least EUR 50 and no more than EUR 200, payable in the equivalent amount in denars.
2.8 During breaks, stops or police checks, Passengers shall leave the bus if requested to do so by the bus crew. Passengers must observe the duration of the break specified by the bus crew. The driving personnel are authorised to continue the journey if a Passenger does not return to the bus by the end of the specified break period and shall not be liable for the Passenger’s absence after that period has expired.
2.9 Each Passenger travelling across an international border shall be solely responsible for complying with all laws and regulations concerning the required travel documents, visas, customs requirements and health regulations. The Carrier shall not be liable for any consequences resulting from the Passenger’s failure to comply with such laws and regulations, even if they are amended after the Travel Ticket has been purchased.
3 Obligations and Liability of the Carrier
3.1 Under the Contract of Carriage or Travel Ticket, the Carrier undertakes to transport the Passenger to a specified destination, while the Passenger undertakes to pay the appropriate fare to the Carrier.
3.2 The Carrier shall transport the Passenger according to the published timetable and the purchased Travel Ticket, using a vehicle that meets the requirements established by the regulations governing vehicles and the specific technical and operational requirements prescribed for the individual types of transport.
3.3 The Carrier shall issue the Passenger a Travel Ticket in paper or electronic form.
3.4 The Carrier shall be liable for damage resulting from the death, impairment of health or injury of the Passenger, as well as for damage resulting from a delay or interruption of the journey.
3.5 The Carrier shall be liable for damage resulting from the death, impairment of health or injury of the Passenger if such damage occurred while the Passenger was inside the vehicle.
3.6 The Carrier shall not be liable for damage resulting from the death, impairment of health or injury of the Passenger if the Carrier proves that the damage was caused by an action of the Passenger or by an external cause that could not have been foreseen, avoided or prevented.
3.7 The Carrier shall not be liable for damage resulting from a delay or interruption of the journey if the Carrier proves that the delay or interruption did not occur due to its fault.
3.8 For damage resulting from the death, impairment of health or injury of the Passenger, the Carrier shall be liable up to the insured amount stated in the policy issued by the insurance company with which the Carrier has concluded an agreement for passenger insurance. For damage resulting from a delay or interruption of the journey, the Carrier shall be liable up to twice the amount paid for transport on the relevant route.
3.9 For damage resulting from the loss of or damage to Baggage, the Carrier shall be liable in accordance with the provisions of the Law on Contracts for Carriage in Road Transport relating to compensation for the loss of or damage to items accepted for transport, but only if the damage occurred due to the fault of the Carrier.
The Carrier shall not be liable for damage resulting from the loss of or damage to Baggage if the Passenger does not submit a complaint to the Carrier immediately after the completion of the journey or after collecting the Baggage.
The Baggage shall be presumed lost if it has not been delivered to the Passenger within 30 days from the date on which the Passenger completed the journey.
4 Travel Ticket Cancellation and Refunds
4.1 The Passenger has the right to cancel the Travel Ticket before commencing the journey.
4.2 The Carrier shall retain 10% (ten percent) of the amount paid by the Passenger for the relevant journey if the Passenger cancels the journey no later than two hours before the scheduled departure in domestic road transport or six hours before the scheduled departure in international road transport.
4.3 If the Passenger exercises the right referred to in Section 4.1 outside the time limits set out in Section 4.2, the Carrier shall be entitled to compensation amounting to 50% of the amount paid for the relevant journey.
4.4 Refunds resulting from the cancellation of a journey shall be made to the Passenger’s bank account used to purchase the Travel Ticket electronically. If the Travel Ticket was purchased in cash at the bus station, the refund shall be processed at the Company’s head office.
4.5 Any bank fees incurred as a result of refunding the Travel Ticket amount to a bank account shall be borne and paid by the Passenger.
5 Transport of Baggage
5.1 By purchasing the Travel Ticket, the Passenger acquires the right to carry, without an additional charge, Baggage weighing up to 25 kilograms, consisting of one travel bag with dimensions of 100 cm × 60 cm or two travel bags with dimensions of 50 cm × 30 cm.
5.2 For additional Baggage in international road transport, a fee equal to 10% of the Travel Ticket price shall be charged per bag, while in intermunicipal transport a fee of 10 denars shall be charged per bag.
5.3 Hand Baggage shall be transported without an additional charge but shall be limited to one bag with a maximum weight of 5 kilograms and dimensions of 40 × 30 × 18 cm.
6 Transport of Pets
6.1 The transport of pets is prohibited on all intermunicipal and international routes operated by the Carrier.
7 Rights of Passengers in the Event of Delay or Cancellation of Transport
7.1 If the transport does not commence at the time specified in the Travel Ticket, the Contract of Carriage or the Carrier’s timetable, the Passenger, the Transport User and/or the Transport Organiser may cancel the Travel Ticket or terminate the Contract of Carriage and request a refund of the amount paid for the agreed transport, provided that the transport is delayed by more than 1 hour from the time specified in the Travel Ticket, the Contract of Carriage or the Carrier’s timetable.
7.2 If the transport is interrupted during the journey for reasons for which the Passenger is not responsible, the Passenger shall have the right to request that the Carrier transport the Passenger, together with the Baggage, using its own vehicle or another suitable means of transport, to the final destination for which the Passenger purchased the Travel Ticket.
7.3 If the Carrier does not continue the Passenger’s transport to the final destination for which the Passenger purchased the Travel Ticket within 60 minutes in domestic passenger transport or within 180 minutes in international passenger transport, the Passenger shall have the right to request that the Carrier return the Passenger, together with the Baggage, to the Place of Departure and refund the amount paid for the relevant transport.
7.4 In addition to the right referred to in Section 7.3, if a particular journey is cancelled entirely or delayed by more than 60 minutes in domestic passenger transport or by more than 180 minutes in international passenger transport, the Passenger shall have the right to choose one of the following options:
a) request a full refund of the amount paid for the Travel Ticket;
b) request a free return journey on the same route.
The refund shall be made within 10 (ten) working days from the date of receipt of the relevant request. Passengers may submit their requests electronically to the Carrier’s official email address, [email protected], or in paper form to the Carrier’s registered office at Nikola Tesla Street No. 160, 7000 Bitola, North Macedonia.
8 Final Provisions
8.1 For all matters not provided for in this document, the provisions of the applicable laws and regulations of the Republic of North Macedonia governing the relevant subject matter shall apply.
8.2 In the event of a dispute, the Basic Court in Bitola shall have jurisdiction to resolve it.
